Independent Service Provider Agreement

This agreement sets the minimum operating standards for independent technicians using MalwaFix. The final commercial version should be reviewed by a qualified Indian lawyer before a large public launch.

1. Electronic acceptance

Acceptance is recorded against the technician account with the agreement version, date and time, acceptance source and basic browser information. A later agreement version may require fresh acceptance. Account creation or agreement acceptance does not guarantee assignments or income.

2. Independent status

The technician provides services independently, chooses availability, supplies tools unless separately agreed, and remains responsible for lawful, competent and safe performance. Approval does not create employment, partnership, agency, guaranteed bookings or guaranteed income.

3. Eligibility and identity

The technician must be at least 18, provide their own contact number and accurate information, and complete any identity or reference checks required by MalwaFix during offline onboarding. When a document is requested, only an approved private channel may be used. Never send biometric data, an Aadhaar OTP, VID, DigiLocker password, Aadhaar App PIN or another person’s document.

4. Accurate profile

The technician must keep their legal name, service category, experience, service areas, references, licences and contact information accurate and promptly report material changes. Account sharing, false information and use of another technician’s credentials are prohibited.

5. Booking assignment

Customer details may be accessed only for a booking assigned to the technician. The technician should accept only work they are competent and legally permitted to perform, contact the customer for the assigned purpose and promptly update the booking status.

7. Payment and records

During the initial pilot, payment is generally made directly by the customer after service completion. The technician is responsible for legally required receipts, tax, warranty commitments and business records. Never request a banking OTP, card PIN or UPI PIN.

9. Customer information

Use a customer’s phone number, address, photographs and booking details only for the assigned job, support or a legitimate dispute. Do not retain, publish, sell or use customer data for unrelated marketing. Delete unnecessary local copies after the job and applicable dispute period.

10. Conduct

Harassment, discrimination, threats, intoxication while working, theft, deliberate property damage, fraud, fake reviews, account sharing, unauthorised subcontracting and misuse of customer information are prohibited.

11. Photos and evidence

Before-and-after photographs or videos require the customer’s knowledge and should avoid faces, identity documents, family members and unrelated private areas. Evidence may be retained only as necessary for the booking, warranty, quality review or dispute.

12. Complaints and cooperation

The technician must respond honestly to complaint and safety reviews, preserve relevant job evidence and cooperate with lawful requests. MalwaFix may pause assignments while a serious report, fraud concern or document issue is investigated.

13. Rejection, suspension and termination

MalwaFix may reject, suspend or block a profile for false information, identity-document issues, safety concerns, serious or repeated complaints, abuse, fraud, unlawful work, data misuse or breach of this agreement. The technician may stop using the platform and request account closure, subject to unresolved bookings and record-retention needs.

14. Responsibility

The technician is responsible for their work, tools, materials, licences, tax, insurance and legal obligations. Nothing excludes liability that cannot legally be excluded. The final commercial agreement should define insurance, indemnity, platform fees and dispute jurisdiction after the business model is finalised.
